Decision Statement on Education through Labor
of
Administration Committee on Education through Labor of Hetian District

Person placed under education through labor:  Wusimanyiming.  He is a male of Uyghur ethnicity and is currently 35 years of age.  He was born on October 27, 1972.  Identification No.: 653222197210270813.  His original residential address:  Team 3, Wuerqi Village, Zhawa Township, Moyu County.  Current address: 95, Paheta Lane, 2nd Ring Road, Xiaoerbage Township, Hetian City.  He has a college education.  After graduation, he went to work at Propaganda Office of Zhawa Township of Moyu County.  In 1998, he quit his public employment and was hired by Luofu County Branch of Xinjiang Pacific Agricultural Resources Development Company, Ltd.  Currently, he doesn’t have a permanent employment.  On October 21, 2004, he was placed under supervised residence for a violation of law.  On November 18, 2004, his family paid the bail and the supervised residence was canceled.  On October 18, 2005, his bail was canceled.  On July 26, 2007, he was again placed under supervised residence (at home).  On November 19, 2007, he was placed under criminal detention.
Through investigation, he was found to have violated the following:
During his work at Luofu County Branch of Xinjiang Pacific Agricultural Resources Development Company, Ltd. from March of 1998 through April of 2004, he assisted foreigners in illegal activities.
The above criminal activities by Wusimanyiming are clear and are based on solid evidence.  Pursuant to Clause 1, Article 10 of “Pilot Program of Implementation of Education through Labor” promulgated by the State Council, it is decided that Wusimanyiming be sentenced to two years of education through labor.
Pursuant to the applicable law, the eight days of detention on Wusimanyiming before this decision on education through labor was made shall be included in the days for his program of education through labor.
The term for the program starts from November 27, 2007 to November 18, 2009.
Pursuant to the applicable law, those people placed under the program of education through labor who are eligible to serve outside sites for education through labor can do so outside the these sites for education through labor.
If the person does not accept this decision, he or she can apply for an administrative reconsideration within 60 days from receiving this decision statement at Administration Committee on Education through Labor of Xinjiang Uyghur Autonomous Region or submit litigation directly at Hetian Municipal People’s Procurator within three days after receiving this decision statement.

The person placed under education through labor and their family, their work unit and the victims shall each have a copy of this decision statement.  The center for education through labor shall have one copy and four copies shall be archived.

Pursuant to Article 61 of “The Criminal Procedure Law of the People’s Republic of China,” this bureau put Wusiman Yiming under criminal detention on suspicion of disclosing state secrets at 7:00 on November 19, 2007.  Wusiman Yiming is currently being detained at Hetian District Detention Center.
This copy is to be handed over to the family or work unit of the detainee.
