The Prosecution Paper against brother Liu Fenggang and two other Christians by Zhejiang Government

(Zhejiang, China – August 1, 2009) ChinaAid released the prosecution paper against brother Liu Fenggang and two other Christians by Zhejiang Governmentby People’s Procuratorate in Hangzhou, Zhejiang Province in 2004. Brother Liu was sentenced to three years imprisonment for the so-called ‘revealing state secret to overseas organizations”. The other two brothers, brother Xu Yonghai and Zhang Shengqi received two years and one year sentence respectively in the same case with same charge. In this case, he was put under residential surveillance beginning October 13, 2003 by Hangzhou Public Security Bureau, Xiaoshan District Substation. On November 14, 2003, he was placed under criminal detention. On December 4, he was arrested with the approval of Xiaoshan District People’s Procuratorate.

Address: Zhang village, Wangji town, Cao County, Shandong province.In this case, he was arrested with the approval of Xiaoshan District People’s Procuratorate.
According to the investigation of the Hangzhou Public Security Bureau Xiaoshan Distrct Substation, the defendants Liu Fenggang, Xu Yonghai and Zhang Shengqi were indicted by Xiaoshan District People’s Procuratorate on February 4, 2004 for spying and illegally providing information to overseas organizations and their staff. The case was placed under investigation the next day, and the defendants were informed of their rights to have a defense attorney. After the case was accepted by the Procuratorate, the defendants were interrogated and all the materials were investigated. The investigation results:
In October 2001, defendant Xu Yonghai provided Liu Fenggang with 1,000 RMB as traveling funds. Defendant Liu Fenggang was sent to Anshan city in Liaoning province to investigate the situation of Li Baozhi’s labor re-education for participating in cult. After that, Liu Fenggang wrote a report titled “The facts that I learned in Li Baozhi’s ‘cult’ case in Ansha city Liaoning province.” It was later sent to “Life Journal” by defendant Xu Yonghai and was published in Issue #20 of this overseas magazine. Also, the editor mailed two magazines and $50 to Liu Fenggang and Xu Yonghai. On July 25, 2003, defendant Liu Fenggang, sent by Bob Fu the member of the U.S.-based “Committee for Investigation on Persecution of Religion in China,” went to Hangzhou city, Xiaoshan area, Xihu area and Wenzhou city to investigate the so-called situation of “persecution” of Christians. After he came back to Beijing, he wrote a report titled “The report from motherland.” (It is also titled “The facts that I learned regarding the persecution of Christians in Zhejiang province.”).On August 5, 2003, at defendant Liu Fenggang’s instigation, Zhang Sheng sent this report to Bob Fu via e-mail. On August 18, 2003, according to his interrogation by police during a Christian house church assembly in Beijing, Miyun County, Dachengzi town on August 17, defendant Liu Fenggang wrote a report titled “How I was interrogated by police when preaching the Gospel in the outer suburbs of Beijing.” Later, the article was printed by defendant Zhang Shengqi. Then, they used the same method mentioned above to send it to Bob Fu, a member of the U.S.-based “Committee for Investigation on Persecution of Religion in China.” The evidence for the above facts are as follows:1. The statement and vindication of defendants Liu Fenggang, Xu Yonghai and Zhang Shengqi2. The testimony of witness Li Baozhi, etc.3. The State Security Bureau and Zhejiang Province Security Bureau’s verification4. “Life Journal” magazine, etc.5. An MP3 player, a digital camera, etc. The conclusion of People’s Procuratorate in Hangzhou, Zhejiang province:

 

Defendants Liu Fenggang, Xu Yonghai and Zhang Shengqi have been illegally spying and providing state secrets and intelligence to overseas organizations. These actions have all violated “The Criminal Law of the People’s Republic China,” Article 111. Criminal facts and evidence are certain and adequate. Therefore, the defendants should be prosecuted for their criminal liability in spying and illegally providing state intelligence to overseas organizations. According to “The Criminal Law of the People’s Republic China,” Article 141, we bring in an indictment, and request a judgment be made in accordance with the law.
