Decision Statement of Public Security Administrative Penalty
                              Qu Gong (Xing) Jue Zi [2008] No. 137.
Person receiving the penalty: Yan Chuanfang. Gender: Female. Date of Birth: December 27, 1944.  She resides in the Family Member Building across the street from No. 3 Middle School of Qujiang Township.
It is found clearly through investigations that at about 9 a.m. on March 30, 2008, over 10 illegal actors against the law Yan Chuanfang, Li Xianbi, Yu Liyu and others illegally gathered at the residence of Li Xianbi to engage in cult activities located at 77, Xinglong Lane, North Street of Qujiang Township, Qu County.  They were caught on the spot.
The above facts are supported by the following evidence: 1: Documentary evidence; 2: testimonies from witnesses; 3: statements and defense of the person receiving the penalty and other pieces of evidence.
Pursuant to Item 1, Clause 1, Article 27 of “Penalty Law of Public Security Management of People’s Republic of China,” it is decided that Yan Chuanfang receive five days of administrative detention.
Method of implementation: The policemen in charge of this case shall take her to Qu County Administrative House of Detention for detention.  If the person receiving the penalty does not accept this decision, she may apply for an administrative reconsideration at Qu County People’s Government or Dazhou Municipal Public Security Bureau within 60 days after receiving this decision statement or she may file an administrative lawsuit at Qu County People’s Court within three months.

It is found clearly through investigations that at about 3 p.m. on March 29, 2008, over 50 illegal actors against the law, including Zhou Yanying, Zhang Mingxiu, Yan Zelie and others illegally gathered at the residence of a resident to engage in cult activities located in the North Street of Qujiang Township, Qu County.
The above facts are supported by the following evidence: 1: Documentary evidence; 2: testimonies from witnesses; 3: statements and defense of the person receiving the penalty and other pieces of evidence.
Pursuant to Item 1, Clause 1, Article 27 of “Penalty Law of Public Security Management of People’s Republic of China,” it is decided that Zhou Yanying receive five days of administrative detention.

Pursuant to Article 61 of the “Procedural Law of the People’s Republic of China,” this bureau placed Wang Xiuqing on criminal detention on suspicion of utilizing a cult organization to undermine the implementation of the state law and regulations.  Currently, Wang Xiuqing is being detained at Qu County House of Detention.

Person who has violated the law: Li Chixia (gender: female; of Han Nationality.  Date of Birth: April 23, 1972.  ID No.: 51303019720423024X)  She is a native of Qu County, Sichuan Province and resides at Group 4, Bameng Village, Tianxing Township, Qu County.
Qu County Public Security Bureau has brought up these charges:  Since 2006, this Wang has worked with Li Chixia (who has been placed under education-through-labor program) and other people in holding illegal gatherings at the residences of Chen XX and Li XX located at North Street, Qujiang Township, Qu County.  Through “Adult Class,” “Youth Class” and “Summer and Winter Class,” they preached anti-science, anti-humanity and anti-social heresies of the cult organization called “Total Scope Church” to seniors living alone, middle-aged and old unemployed people frail in health or children living alone and students at schools.  They seriously disrupted the public security in the local area.  On March 30, 2008, as this Li, Wan XX (handled in a separate case), Lei XX and others were engaging in cultist activities in North Street, Qujiang Township, Qu County, they were arrested by the police.
It is found through investigation and review by this committee that since 2006, this Li has worked with Wang Xiuqing (who has been placed under education-through-labor program) and other people in holding illegal gatherings in the residences of Chen XX and Li XX located at North Street, Qujiang Township, Qu County.  Through “Adult Class,” “Youth Class” and “Summer and Winter Class,” they preached anti-science, anti-humanity and anti-social heresies of the cult organization called “Total Scope Church” to seniors living alone, middle-aged and old unemployed people frail in health or children living alone and students at schools.  They seriously disrupted the public security in the local area.  On March 30, 2008, as this Wang, Wan XX (handled in a separate case), Lei XX and others were engaging in cultist activities in North Street, Qujiang Township, Qu County, they were arrested by the police.
The above facts are supported by the following evidence: 1: the statements and arguments of Li Chixia herself who violated the law; 2: the statements by Wang Qingxiu and other people who are involved in the same case; 3: testimonies from witnesses; 4: documentary evidence, etc.
To sum up, this committee believes that the illegal actor against the law Li Chixia utilized a cult organization to undermine the implementation of the law of the state and disrupted the public security.  The facts are clear and evidence is accurate and full, which meets the eligibility of the education through labor program.
Pursuant to Item 4, Article 10 and Article 13 of the “Pilot Program for Education through Labor” set forth by the State Council, it is decided to place Wang Qingxiu in a one-year program of education through labor (Li Chixia was placed under detention before the education through labor was decided.  One day shall be deducted from the education-through-labor program for every day she was placed under the detention.  The term of the education through labor starts from March 30, 2008 and ends on March 29, 2009)
If the person concerned here does not accept this decision, she may apply for a reconsideration at Dazhou Municipal People’s Government or Education through Labor Management Committee of Sichuan People’s Government within 60 days after receiving this decision statement or she can file a lawsuit at the People’s Court within three months.

Decision Statement of Bail Pending Trial

Qu Gong Xing Bao Zi [2008] No. 60
April 11, 2008
Criminal suspect: Xiao Yu. Gender: female. Age: 50. Residential address: Group 3, Bameng Village, Tianxing Township, Qu County.  Work unit and occupation: farming.
Xiao Yu whom this bureau is investigating is suspected of utilizing a cult organization in undermining the law of the state and the implementation of the administrative regulations.  As the criminal suspect may be sentenced to punishment beyond fixed-term imprisonment, bail pending trial may not endanger the society.  Pursuant to Article 51—1-2 of the “Procedural Law of the People’s Republic of China,” it is decided that she be placed on bail pending trial.  The term starts from April 12, 2008.  The criminal suspect should receive the supervision of the guarantor and pay the bail.
During the period of bail pending trial, the person who is on bail pending trial should abide by the following stipulations:
1. She must not leave the city or county town of her residence without prior approval from the executing agency.
2. She must be present in time when summoned.
3. She must not disrupt witnesses in any way from presenting their testimonies.
4. She must not destroy or forge evidence or collude with other people to unify their confessions.
Should the criminal suspect violate the above stipulations during the period of bail pending trial, the bail shall be confiscated.  Depending on specific situations, the criminal suspect shall be ordered to sign a statement of repentance and pay again the bail, find a guarantor or be placed under supervised residence and they shall be arrested.
