Bill of Indictment of Huocheng County People’s Procuratorate of Xinjiang Uyghur Autonomous Region

He was placed under criminal detention on May 17, 2008 by Huocheng County Public Security Bureau on suspicion of inciting secession of the state. On June 19 of the same year, he was arrested according to law upon approval by this procuratorate on suspicion of utilizing superstition to undermine implementation of the law. Currently, he is being detained at Huocheng County Detention Center.

The case is complete at Huocheng County Public Security Bureau. The defendant Lou Yuanqi is suspected of utilizing superstition to undermine implementation of the law and the case was submitted to this procuratorate on August 5, 2008 for review and prosecution. After this procuratorate accepted the case, it notified the defendant on August 6, 2008 that he has the right to hire a defense counsel and it also notified the defendant accordingly as provided by the law.  All the materials on this case have been reviewed.

On August 11, 2008, the case was returned to the Public Security agency for an additional investigation. On September 12 of the same year, it was submitted to the court.  On October 10 of the same year, the People’s Procuratorate of Yili Prefecture assigned this case to this procuratorate for processing.

It has been found out through reviews as provided by the law that since 2000, the defendant Lou Yuanqi did not give classes or preach the religion in places assigned by the government. Instead, he organized people in his own residence in preaching the religion. After the administrative agencies of the local government gave him education and issued penalties on him on many occasions, he still would not mend his ways.

From February to April of 2008, the defendant Lou Yuanqi contacted overseas individuals and organizations on many occasions and provided them with untrue information to create international public opinions in an attempt to make the government recognize the Christian church founded by him.

The evidence for the above facts is as follows:
1. Testimony from the witness Liu Mingxiang
2. Documentary evidence, material evidence
3. Confession and defense by the defendant Lou Yuanqi

This procuratorate believes that the defendant Lou Yuanqi utilized superstition to undermine the implementation of the law of the state and the administrative regulations. His conduct has violated Article 300 of the “Criminal Law of the People’s Republic of China.” The fact of his crime is clear and the evidence is accurate and sufficient. He should therefore be investigated for criminal liability in undermining the implementation of the law. Pursuant to Article 141 of the “Criminal Procedural Law of the People’s Republic of China,” he is therefore prosecuted.  Please sentence him according to law.
