Defendant FENG Qunhao, born June 13, 1976,

Han ethnicity attained Secondary school, the domicile of origin is No. 15, Tao Chong New Village Committee, Dongcheng Subdistrict, Zhaoqing City, Sihui County, Guangdong Province.
Defendant HAN Li, born November 14, 1981,
residential identity card No.: 460022198111143742,
Han ethnicity, attained a college degree, domicile: No. 16. Second Villiage of Baiqiu, Wenchang City, provincial-controlled division of Hainan.
Defendants listed above were detained on 7/3/2020 by the Public Security Bureau of Bao’an Branch, Shenzhen Municipality on suspicion of “unlawful business operation.” Suspects were found guilty of “unlawful business operation” and arrested on 06/08/2020 per the approval of this procuratorate, by the Public Security Bureau of Bao’an Branch, Shenzhen Municipality; currently in custody.
The Public Security Bureau of Bao’an Branch, Shenzhen Municipality terminated the investigations of this case. On 09/2302020, this procuratorate transferred defendants FU Xuanjuan, DENG Tianyong, FENG Qunhao, HAN Li to prosecution on the accounts of “unlawful business operation.” After the acceptance of this case, the procuratorate has informed the defendant of his/her right to entrust a defender as well as the possible legal consequences of pleading guilty, legally interrogated defendants; listened to the statements of defendants and the opinions of the lawyer on duty; examined all case materials.
After legal examination, it is ascertained:
Defendant FU Xuanjuan, the legal person of Shenzhen’s Tree of Life Technological Development Co,. Ltd (established on 08/17/2020); the primary business item is the sale of electronic players pre-installed with biblical and religious contents on internet platforms. Defendants DENG Tianyong and FENG Qunhao had been working at this company since it was founded. Defendant DENG Tianyong was responsible for auditing the downloaded contents in the electronic players and manage minor matters. Defendant FENG Qunhan was the company’s technician, responsible for copying and burning the related videos audited by DENG Tianyong, as well as completed after-sales repairs. Defendant HAN Li joined the company in May 2019 as the front desk receptionist and managed finance, in charge of package and shipping as well as the company’s financial expenditure settlements. From January 2018 to June 2020, this company is suspected of the amount for unlawful business operation of RMB 3661847.84, of which RMB 1261199.66 were from May 2019 to June 2020.
16:00 of 07/02/2020, investigating organ arrested defendants FU Xuanjuan, DENG Tianyong, FENG Qunhao, HAN Li at unit 701A of Henglin Building on Xixiang Street fisheries village in Bao’an district.
The ascertained facts of the evidence mentioned above are as below:

Records of crime scene investigation, examination, identification, and investigative experiments and audio-visual materials
As authorities adhered to statutory procedures when gathering and obtaining the above-mentioned evidence, information is accurate and objective enough to ascertain the crimes’ clear facts. Defendants FU Xuanjuan, DENG Tianyong, FENG Qunhao, and HAN Li have no objections to the facts and evidence of crimes charged and are willing to plead guilty and accept punishments.
The procuratorate found that defendants FU Xuanjuan, DENG Tianyong, FENG Qunhao, and HAN Li disregarded the law of this country, unlawfully publishing and copying of publications; seriously disrupted the market order. The case is severe and such acts violated article 225 of the Criminal Law of the People’s Republic of China. Facts of crimes are clear, and evidence is sufficient and concrete, and should be investigated for the criminal liabilities of unlawful business operation.
In consideration of FU Xuanjuan, DENG Tianyong, FENG Qunhao, and HAN Li pleading guilty and accepting punishments, the recommended sentence for FU Xuanjuan is five years of fixed-term imprisonment and fine, the recommended sentence for DENG Tianyong is three years of fixed-term imprisonment and fine, recommended sentence for FENG Qunhao is three years of fixed-term imprisonment and fine, recommended sentence for HAN Li is a One year and six months and fine.
According to article 176 of the Criminal Procedure Law of the People’s Republic of China, proposed indictment, please sentence according to law.
